Welcome to Coco Palm Clothing. In these Terms, "we", "us" and "our" mean Coco Palm Clothing Inc., a company incorporated in British Columbia, Canada. We operate this store and website, including all related content, features, tools, products and services (the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with the policies referred to in them, set out your rights and responsibilities when you use the Services. Please read them, as they include important information about warranties and our liability.
By using the Services you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.
1. Using the store
By agreeing to these Terms you confirm that you are at least the age of majority where you live, or that you have your parent or guardian's consent.
To place an order we'll ask for information including your email address, billing details and shipping address. You agree that everything you give us is accurate, current and complete.
If you create an account, you're responsible for keeping your login details secure and for activity on your account. Accounts can't be transferred or sold.
2. Our products
We do our best to represent our products accurately, but colours and appearance can vary depending on your screen and its settings. Measurements and size charts are provided as a guide.
Product descriptions and prices may change without notice, and we may discontinue a product or limit quantities at our discretion.
Nothing in this section affects the statutory guarantees you have under British Columbia's Sale of Goods Act or equivalent consumer protection law where you live. Products must be as described and of acceptable quality, and if something arrives faulty we'll put it right. See our Return and Refund Policy.
3. Orders
When you place an order you're making an offer to buy. We may accept or decline any order at our discretion, and your order isn't accepted until we confirm it. We need to receive your payment before an order is accepted.
You can cancel an unfulfilled order within 24 hours of placing it through your order status page. After that, or once your order has shipped, our Return and Refund Policy applies instead.
If we decline, change or cancel your order, we'll contact you using the details you gave us.
Our products are sold for personal use rather than for commercial resale.
4. Prices and payment
Prices, discounts and promotions can change without notice. The price you pay is the price shown when you place your order, confirmed in your order confirmation email. All prices are in Canadian dollars unless your currency is converted at checkout.
Unless stated otherwise, prices don't include taxes or shipping, which are calculated and shown at checkout before you pay. Customs and duties are included on Standard shipping and charged separately on Priority shipping, as set out in our Shipping Policy.
Where a promotion has its own terms and those conflict with these Terms, the promotion's terms apply to that promotion.
You confirm that the payment details you provide are accurate, that you're authorised to use the payment method, and that you'll pay the amounts charged.
5. Shipping and delivery
Delivery times are estimates rather than guarantees, and we're not able to control delays caused by carriers, customs processing or events outside our control.
If your parcel doesn't arrive, or arrives damaged, contact us and we'll work with the carrier to resolve it. See our Shipping Policy for details.
6. Intellectual property
The Services, including our trademarks, text, images, graphics, video and audio and the way they're arranged, belong to Coco Palm Clothing Inc. or our licensors and are protected by Canadian and international intellectual property law.
You may use the Services for your own personal, non-commercial purposes. Please don't reproduce, distribute, modify, republish or transmit material from the Services without our written permission.
The Coco Palm Clothing name, logo and designs are our trademarks. Shopify's name and logo are trademarks of Shopify. Other names and logos on the Services belong to their respective owners.
7. Third-party tools and links
The Services may give you access to tools and links provided by third parties that we neither control nor monitor. These are provided as they are, without warranties of any kind, and using them is at your own discretion.
If you leave our Services to visit a third-party site, please review their terms and privacy practices. Questions or complaints about third-party products and services should go to that third party.
8. Prohibited uses
You may use the Services for lawful purposes only. You must not use them to break the law, infringe anyone's intellectual property, harass or defame anyone, transmit false information, send spam, impersonate anyone, or interfere with other people's use of the Services.
You also agree not to upload malicious code, copy or resell any part of the Services, collect other people's personal information, or use bots, scrapers, AI agents or similar tools to access the Services except as permitted below, or to bypass any security measure.
We may suspend or close your account if you breach these Terms.
9. Automated agents
If you use or deploy software that acts autonomously or semi-autonomously on your behalf (an "Agent") to interact with the Services, that Agent must identify itself in its user agent string in the form "Agent/[agent name]", must not disguise itself as a human, must answer truthfully if asked whether it is automated, and must not circumvent CAPTCHAs or any measure intended to control automated access.
We may limit or block Agent access to the Services by technical or other means.
10. Relationship with Shopify
Coco Palm Clothing is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Coco Palm Clothing. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Coco Palm Clothing, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Coco Palm Clothing.
11. Privacy
Personal information we collect through the Services is handled in accordance with our Privacy Policy. Because the Services are hosted by Shopify, some information is also processed by Shopify under their own privacy policy, and may be transmitted outside the country where you live.
12. Reviews and feedback
If you send us reviews, ideas, suggestions or other content, you give us permission to use, reproduce, modify, publish and display it, including for commercial purposes, without payment to you.
You confirm that anything you send is yours to send, that you've disclosed any incentive you received for it, and that it isn't unlawful, defamatory, obscene or harmful. We're not obliged to publish, keep confidential, or respond to anything you send, and we may remove content we consider inappropriate.
13. Errors and corrections
Occasionally there may be typographical errors, inaccuracies or omissions on the Services relating to product descriptions, prices, promotions, shipping charges, transit times or availability.
We may correct these and update or cancel affected orders, including after you've placed one. If we cancel an order for this reason, we'll refund you in full.
14. Warranties
Except as set out in these Terms and in our Return and Refund Policy, and to the extent permitted by law, the Services are provided as they are and as available, without warranties or conditions of any kind.
We don't warrant that the Services will be uninterrupted, timely, secure or error free, or that information on them is complete or accurate.
Nothing in this section limits or excludes any warranty, condition or guarantee that applies to you under consumer protection law and that cannot lawfully be excluded.
15. Our liability
To the extent permitted by law, we are not liable for indirect, incidental, special, punitive or consequential loss, including lost profits, lost revenue or loss of data, arising from your use of the Services or any product bought through them.
Where we are found liable, our total liability to you is limited to the amount you paid for the order the claim relates to.
Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Nothing in this section affects your statutory rights as a consumer.
16. Indemnity
You agree to indemnify Coco Palm Clothing Inc., Shopify, and our respective affiliates, officers, directors, employees and service providers against claims, losses and reasonable legal costs arising from your breach of these Terms, your violation of the law or another person's rights, or your use of the Services.
17. Termination
We may end this agreement or your access to the Services at any time. Amounts owing up to that point remain payable.
Sections that by their nature should continue after termination will do so, including those covering intellectual property, feedback, warranties, liability, indemnity and governing law.
18. General
If any part of these Terms is found to be unenforceable, that part is severed and the rest continues to apply.
If we don't enforce a right under these Terms, that isn't a waiver of it.
These Terms, together with the policies referred to in them, are the whole agreement between us and replace anything agreed previously.
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours.
Headings are for convenience and don't affect how these Terms are read.
19. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have jurisdiction over any dispute, though this doesn't remove any right you may have to bring a claim in the courts of the country where you live.
20. Changes to these Terms
The current version of these Terms is always on this page. We may update them from time to time by posting a revised version here and changing the date at the top. Continuing to use the Services after we do means you accept the change.
